Welcome to Billtro! These Terms and Conditions (“Terms”, “Agreement”) govern your use of the Billtro mobile app (“App”, “Service”), owned and operated by Billtro Tech (“we,” “us,” “our”). By downloading or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. Use of the App
Eligibility: You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement.
License to Use: We grant you a non-transferable, non-exclusive, revocable license to use the App solely for your business purposes. You may not use the App for any illegal or unauthorized purposes.
Restrictions: You agree not to:
• Reverse engineer, decompile, or disassemble any part of the App.
• Modify, copy, or distribute any content from the App without our prior written permission.
• Use the App to violate any applicable local, national, or international laws.
• Access or attempt to access other users’ accounts without permission.
2. User Accounts
To use certain features of the App, you may be required to create an account. You agree to provide accurate and complete information and to keep this information updated. You are responsible for safeguarding your account credentials, and you agree to notify us immediately of any unauthorized use of your account.
Account Termination: We reserve the right to terminate your account or restrict your access to the App at our sole discretion if you violate these Terms or engage in unlawful activity.
3. Fees and Payments
The use of certain features of the App may be subject to fees. If fees apply, they will be clearly disclosed before you make any payment. You agree to pay all applicable fees on time and according to the terms set forth in the App.
Refunds: All purchases are final, and we do not offer refunds unless required by law or explicitly stated otherwise in the app.
4. Data and Privacy
Your use of the App is also governed by our Privacy Policy. We are committed to protecting your privacy and ensuring that your personal information is handled in accordance with applicable laws, including Nepal’s Privacy Act of 2018, GDPR, and CCPA where applicable.
By using the App, you consent to the collection, use, and storage of your data as outlined in our Privacy Policy.
5. Intellectual Property
All content, features, and functionality of the App, including but not limited to software, text, graphics, logos, icons, and images, are the exclusive property of Billtro Tech or its licensors and are protected by international copyright, trademark, patent, and other intellectual property laws.
You may not reproduce, modify, or distribute any part of the App without our prior written consent.
6. Third-Party Services
The App may integrate or provide links to third-party services (e.g., payment processors). Your use of such services is subject to the terms and conditions of the respective third parties. We do not control or assume liability for third-party services and you access them at your own risk.
7. Disclaimer of Warranties
The App is provided “as is” and “as available” without any warranties, either express or implied. We do not guarantee that the App will be error-free, uninterrupted, or secure. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
No Liability for Data Loss: You acknowledge that the use of the App may involve the transmission of your data, and while we strive to protect your information, we do not guarantee the security of your data. You are responsible for backing up your data.
8. Limitation of Liability
To the fullest extent permitted by law, Billtro Tech, its directors, employees, or agents shall not be liable for any indirect, incidental, special, or consequential damages arising from or in connection with your use of the App, including but not limited to:
• Loss of profits
• Loss of data
• Business interruption
• Any damages related to viruses or security breaches.
Our liability for direct damages, if any, is limited to the amount you have paid for using the App.
9. Indemnification
You agree to indemnify, defend, and hold harmless Billtro Tech and its affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your use of the App, violation of these Terms, or infringement of any third-party rights.
10. Changes to the Terms
We reserve the right to modify or update these Terms at any time. Any changes will be effective upon posting in the App, and it is your responsibility to review the Terms regularly. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to conflict of law principles. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Nepal.
12. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, if you breach any of these Terms. Upon termination, your right to use the App will cease, and any provisions that by their nature should survive termination (e.g., intellectual property, indemnification, liability) will continue to apply.
